GLOSSARY

1.1 Terms used in the Rules and Regulations shall mean:

Rules and Regulations - these rules and regulations of the rehasport.pl online shop.
Activation of rights - the Beneficiary's acquisition of rights to use the Services purchased from the Online Shop.
Beneficiary (Patient) - the Customer or the person entitled to use the Services purchased from the Online Shop by the Customer.
Rehasport helpline - available on (+48) 616 281 181, through which it is possible to place an order, obtain support in the purchasing process, including information on the Goods, Training and Services available at the Online Shop.
Product Sheet - a description of the Goods, Service or Service Package available from the Online Shop.
Customer - a natural person, with full legal capacity, using the Online Shop, including – in particular – making purchases for his or her own account or for the account of someone else and with whom the Agreement is concluded.
Shopping Cart - a functionality of the Online Shop displaying Services or Goods selected by the Customer for purchase, as well as the entry and modification of order data such as: the quantity of Services, Goods, invoice data, payment forms, place of performance of the Service, delivery place, Customer data.
Service Provider or Controller – Rehasport Clinic sp. z o. o. with its seat in Poznan (Poland), 60-201 Poznań, ul. Górecka 30, with its registered files held by the District Court Poznań-Nowe Miasto and Wilda in Poznań, 8th Economic Division of the National Court Register under KRS number: 000240810, NIP (tax number): 781 17 72 289, REGON: 300124187, share capital: PLN 83,950.00, Tel. +48 616 281 181, email address: akademia@rehasport.pl, being an entity performing medical activity within the meaning of the Act of 15 April 2011 on medical activity (Journal of Laws of 2020 item 295)
Service Package – a set of Services or other benefits available to the Beneficiary, constituting a certain whole and which can be used within a certain period, in a certain place, for a certain price, from the Online Shop.
Payment Processing Entity – an entity external to Rehasport Clinic Ltd. that mediates the payment process.
Purchase Confirmation – an e-mail message sent by the Online Shop to the e-mail address indicated by the Customer (by remotely filling in an electronic form at the Online Shop) confirming that the ordered service can be provided and the goods delivered.
Online Shop – an online shop operated by Rehasport Clinic sp. z o. o., available at the Internet domain sklep.rehasport.pl
Service – the service sold by the Online Shop as detailed in the Product Sheet.
Order – a declaration of intent by the Customer to purchase a Service from the Online Shop expressed by placing the Service or Goods in the Shoping Cart and proceeding to the next "order and pay” step.
Trainer – a doctor, physiotherapist, dietician or psychologist or other competent person providing training services;
Training – a set of lessons containing movement medicine content, delivered in a classroom format by the Service Provider's Trainers. A list of training courses is available at www.akademiarehasport.pl
Newsletter - an electronic distribution service provided by the Service Provider via e-mail, which enables all Service Recipients who use it to automatically receive from the Service Provider the cyclical content of successive newsletter editions containing information on news and updates at the Online Shop and the Service Provider's training services.
GDPR– Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (Official Journal of the European Union, L No 119, page 1).

GENERAL PROVISIONS

2.1 These Rules and Regulations set out:

rules for the use of the Online Shop,
terms and conditions for placing Orders for Services, Training and Goods offered by the Service Provider and Sellers, available from the Online Shop,
the rules for payments made by the Customer for the Services, Training or Goods purchased from the Online Shop,
the Customer's right to withdraw from the purchase agreement for Services, Training or Goods,
rules for filing and handling complaints.

2.2 In order to use the Online Shop, including browsing the range of products at the Online Shop, it is necessary to have an end device with access to the Internet and a web browser such as Microsoft Edge, Google Chrome, Mozilla Firefox, Opera or Safari in an updated version. Moreover, an active electronic mail (e-mail) account or telephone is required to use certain features of the Online Shop and/or to place Orders.

2.3 Within the framework of the use of the Online Shop, it is prohibited for Customers to provide unlawful content that violates the law or good morals. Furthermore, the customer shall refrain from any activity that could adversely affect the correct functioning of the Online Shop, including, in particular, any interference with the content of the Online Shop or its technical elements. It is also forbidden to use the Online Shop for purposes contrary to its purpose, including sending spam, conducting any commercial, advertising or promotional activities at the Online Shop.

2.4 The Online Shop only sells to natural persons who are consumers as defined by law. Non-consumers may purchase Goods, Training and Services from other sales channels operated by Rehasport Clinic sp. z o.o.

2.5 By purchasing from the Online Shop, the Customer confirms that he/she has full legal capacity.

2.6 Browsing the range of products at the Online Shop and placing Orders by the Customer for Services, Training and Goods in the range of products at the Online Shop does not require registration.

2.7 To place an order for Services, Training or Goods in the range of the Online Shop, it is necessary to fill in the order form available at the website of the Online Shop by providing the data specified in point 4.4 of these Rules and Regulations.

2.8 Placing an order can also be made via the Rehasport Hotline. In this case, the Customer will be asked to read these Rules and Regulations and the Privacy Policy and then the Rehasport Helpline consultant will guide the Customer through the Ordering process described further in the Rules and Regulations.

2.9 Settlement of transactions for the purchase of Services or Goods shall be carried out in accordance with the information at the Online Shop via the payment systems indicated in point 5.2

2.10 The Customer shall comply with the provisions of the Rules and Regulations.

2.11 The User shall use the Online Shop and the training courses in a manner consistent with their intended use, these Rules and Regulations and in a manner consistent with the law, good practices, bearing in mind the respect for personal rights, personal data and copyrights, intellectual property of the Service Provider, other Customers and third parties.

2.12. The Service Provider shall not be liable for disruptions, including interruption of the Website, caused by force majeure, unauthorised acts of third parties or other unforeseeable events.

2.13. The Service Provider shall not be liable for the blocking by e-mail server administrators of the transmission of messages to the e-mail address indicated by the Customers in their order, or for the deletion and/or blocking of e-mails by software installed on the electronic equipment used by the Customers.

INFORMATION ON SERVICES AND GOODS

3.1 Information on the Services, Training and Goods available from the Online Shop constitutes an invitation to conclude a agreement within the meaning of Article 71 of the Civil Code.

3.2 For a detailed description and conditions of use of the Goods, Training or Service provided, please refer to the Product Sheet assigned to it.

3.3 The prices of the products indicated at the Online Shop are given in Polish zloty (PLN); the total cost of the Order (i.e. the prices of all Services, Trainings and Goods included in the same Order) is indicated in the Shopping Cart before the Customer places the Order. Prices are indicated in gross values.

3.4 Rehasport Clinic sp. z o. o. reserves the right to make changes to the prices and type of Goods and Services on an ongoing basis.

CONDITIONS FOR PLACING AND PROCESSING ORDERS (SERVICES AND GOODS):

4.1 The Customer may place Orders for Services and Goods available from the Online Shop for 7 (seven) days a week and 24 (twenty-four) hours a day, subject to prohibitions or restrictions of trade resulting from mandatory legal provisions and technical interruptions.
4.2 Orders can be placed with the help of Rehasport hotline consultants during its opening hours, i.e. Monday to Friday, 8 am to 8 pm.

4.3 Rehasport Clinic sp. z o. o. is not responsible for the quality of the Internet connection at the time of concluding transactions at the Online Shop or for software errors and other defects of the Customer's equipment/device.

4.4. To place an Order, select the Service or Goods that are the subject of the Order and then follow the next steps for concluding the transaction, in particular:

complete the order form by providing: first name, surname, gender, date of birth, PESEL (personal ID number) or passport number and telephone number, home address, mailing address, e-mail address,
accept the Rules and Regulations of the Services,
should you need an invoice, enter the invoice data if different from the data for the receipt of the Service or Goods by the Beneficiary,
select a form of payment,
click the "Order and pay" button.

4.5 Orders and Services will be carried out exclusively in Poland.

4.6 An order is considered to have been correctly placed when the Customer has correctly specified the Goods or configured the Service according to the guidelines available in the Product Sheet in each case and has paid in full.

4.7 The Customer is obliged to truthfully fill in the data indicated in point 4.4 above, which are necessary to create the order.

4.8 In the case of Goods and Services that do not require an appointment booking, an order shall be deemed not to have been placed by the Customer if payment for the Service or Goods is not received within 30 calendar days from the date the form is completed and sent to the Medicover server. In the case of Services requiring an appointment to be booked, an order is deemed not to have been placed by the Customer if payment for the Service is not received within 15 minutes of the forms being completed and sent to the Medicover server.

4.9 Rehasport Clinic sp. z o. o may withhold performance of the agreement if it is impossible or involves a risk of damage to Rehasport Clinic sp. z o. o., if:

the Customer provides incorrect or false data when placing an Order,
the Customer cannot be contacted at the telephone number or e-mail address specified in the Order,
reasonable suspicion of a criminal offence, misdemeanour or any other infringement of the law in connection with the order placed

4.10 The agreement shall be enforceable if doubts are clarified or irregularities are rectified. Medicover may also terminate the Order if the irregularity is irremediable or is not remedied within a reasonable period of time. If Medicover terminates the agreement or the agreement is invalid under the provisions of the Civil Code, the Customer will receive a refund of the price paid. The return of the price paid is tantamount to a declaration by Medicover that the agreement has been terminated or a declaration that the Purchase Confirmation has been waived.

PAYMENT, CONCLUSION OF AGREEMENT AND ORDER PROCESSING

5.1 The full amount due for the Order is displayed in each Order summary. The price shown is the total cost of the Services and/or Goods purchased by the Customer.

5.2 Payment for the Order may be made via the payment systems indicated here, in accordance with the payment method selected at the Online Shop.

5.3 The agreement conclusion date is the date of receipt of the Purchase Confirmation by the Customer.

5.4 Activation of the rights shall take place after the purchase of the Goods or Service and after payment has been made, and the date of commencement or fulfilment will be specified in the Product Sheet.

5.5 The delivery method of the Service or Goods is described in each case in the Product Sheet available at the Online Shop.

5.6 The scope of the Service, the specification of the Goods and the warranty, if any, relating to the Service or the Goods are available in the Product Sheet.

TRAINING

APPLICATION FOR IN-HOUSE TRAINING

6.1.1 The agreement concluded between the Service Provider and the Customer is a distance/remote agreement within the meaning of Chapter III of the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2020 item 287).

6.1.2 In order to conclude the Agreement, the Customer shall sign up for a training course, which is understood to mean filling in a form indicating a wish to sign up for a specific training course. The Agreement is concluded once the Service Provider has confirmed acceptance of the application. The proper performance of the Agreement by the Service Provider is conditional on the Customer paying the full price for the training course.

6.1.3. The Customer can sign up for training by completing and submitting the form available at https://sklep.rehasport.pl/

6.1.4. By applying, you are deemed to have read these Rules and Regulations and to have accepted the terms and conditions contained herein.

6.1.5 Application will be subject to availability.

6.1.6 The Service Provider shall confirm acceptance of the application by e-mail within 7 days of the Customer's request.

6.1.7 The Customer's sign up for the Service Provider's training is equivalent to the booking of a place on the training course.

6.1.8 Customer shall provide complete and truthful personal data and other data required in connection with the creation of an Account.

6.1.9 The Service Provider reserves the right to change the Trainer to another trainer (with the relevant qualifications) within 3 days before the start of the training course, informing the Customers at the same time via e-mail to the e-mail address provided in the form.

TRAINING CANCELLATION

6.2.1 The Customer may withdraw from the training course. The cancellation of a customer's participation in a training course can be done in any form, including by e-mail to akademia@rehasport.pl

6.2.2 In the event that the Customer cancels participation in the training course:

(a) within 30 days before the start of the training course, the Service Provider will refund the Customer the amount paid.

b) Less than 30 days before the start of the training, the amount paid by the Customer is non-refundable.

6.2.3 The Service Provider will refund the sums paid by the Customers within 14 days from the date of cancellation of their participation in the training course.

6.2.4 Up to 3 days before the start of the training course, the Customer shall be entitled to transfer the rights and obligations under the Agreement to another Customer who will be a participant in the training course in question. A change of the Customer's trainee can be made by e-mail to: akademia@rehasport.pl. Any change of trainee must be approved by the Service Provider. In the event of a change of trainee, the entire payment is credited to the new Customer's booking upon receipt of their details.

6.2.5 Up to 3 days before the start of the training course, the Customer is entitled to transfer the funds to another selected training course from the Service Provider's offer. A change in the training course takes place after the Customer has submitted a request to the email address akademia@rehasport.pl. Any change in an in-house training course must be approved by the Training Provider.

CANCELLATION OF TRAINING BY THE SERVICE PROVIDER

6.3.1 The Service Provider reserves the right to cancel a training course, in particular if the minimum number of participants is not reached (the minimum number of participants is 70% of the maximum number of participants indicated on the website) or in case of fortuitous events (e.g. illness of the trainer, unavailability of the training room).

6.3.2 The Service Provider, by cancelling the training, shall not be held financially or otherwise liable for any costs incurred by the Customers in connection with travel and bookings made and which are related to the training (including, but not limited to, costs of bookings or advance payments and fees for travel to the training location or payment related to accommodation).

6.3.3 If a training course is cancelled by the Service Provider, the entire payment will be refunded to all Customers to the bank account numbers of the Customers from which the payment of the Training Price was made, within 14 days of the cancellation of the training course

WITHDRAWAL FROM THE AGREEMENT

7.1. The Customer has the right to withdraw from the Agreement within 14 days of receiving the confirmation of the conclusion of the Agreement.

7.2. An example of the Customer's statement of withdrawal reads:

“Withdrawal from the agreement

I hereby inform, that I withdraw from the agreement concluded remotely with the company REHASPORT CLINIC Spółka z ograniczoną odpowiedzialnością with its registered office in Poznań, the conclusion of which was confirmed to me on ..............................., year....................., City ....................., date ........................,
address ......................................., legible signature ........................"

7.3. If the Agreement has already been performed before the expiry of the withdrawal period, the Customer may not withdraw from the Agreement and refuse to pay the agreed price for the Agreement. The Service Provider may not, however, require the Customer to pay any costs associated with the withdrawal other than the amount of the price, insofar as it has already been performed.

7.4 The Customer may send his/her withdrawal from the Agreement in any form so that it reaches the Service Provider and he/she is able to document the fact of making this withdrawal (including registered letter send to the following address: Górecka 30, 60-201 Poznań, e-mail: akademia@rehasport.pl).

PERSONAL DATA

8.1 Personal data provided by the Customers at the Online Shop are processed by Rehasport Clinic sp. z o. o. with its registered office address: ul. Górecka 30, 60-201 Poznań, (data controller).

8.2 The provision of personal data by the Customer is voluntary, but necessary for the purchase of Goods and Services and the use of the Services. Rehasport Clinic sp. z o. o. processes personal data in order to conclude with the Customer and perform sales agreements for Goods, Training and Services purchased from the Online Shop. 8.3 By providing data, the Customer declares that the personal data provided are his/her own.

8.4 If the Customer includes Beneficiaries' data (including their name, PESEL, address, telephone number or e-mail address) within the Online Shop's service, he or she may only do so on condition that the applicable law and the personal rights of these persons are not infringed.

COMPLAINTS

9.1 Submissions containing questions, suggestions, information about problems with the Online Shop as well as complaints about the training course can be made in one of the following ways:

by filling in an online form available on the website of the Online Shop

9.2 Complaints about the conduct of the training course may be submitted no later than 30 days after the end of the training in question. A complaint about the course of training should include: Customer's name and surname, Customer's address, information regarding the complaint (name of the training course, date and place of the training course), reasons for the complaint, Customer's expectations of the Service Provider with regard to the complaint.

9.3. Complaints relating to service are dealt with within 10 working days, complaints relating to purchased goods and services of which Rehasport Clinic sp. z o. o. is the vendor are dealt with within 30 working days from the date of receipt of all data necessary to consider the complaint at the address: Rehasport Clinic sp. z o. o., ul. Górecka 30, 60-201 Poznań or by email: zakupy@rehasport.pl.

9.4 In the case of a complaint or claim related to the provision of the Service, Training or purchase of Goods, the Customer shall, at the request of Rehasport Clinic sp. z o.o. perform actions enabling Rehasport Clinic sp. z o.o. to receive all information necessary for the proper consideration of the complaint.

9.5 The court of general jurisdiction shall have jurisdiction over disputes arising from the agreement for the sale of Goods, Training or Services.

9.6 Rehasport Clinic sp. z o. o. declares that, in accordance with the agreements concluded with telecommunications operators, these operators should not charge the Customer for telephone calls other than for ordinary telephone calls.

NEWSLETTER

10.1 The Newsletter can be used after three consecutive steps have been performed by the Customer – (1) providing in the Newsletter tab visible at the Online Shop website the e-mail address to which subsequent editions of the Newsletter are to be sent, (2) clicking on the action field; and (3) confirming the intention to subscribe to the Newsletter by clicking on the confirmation link automatically sent to the provided e-mail address.

10.2. The use of the Newsletter is also possible after providing a consent to receive marketing information on training products of Rehasport Clinic Spółka z ograniczoną odpowiedzialnością based in Poznań.

10.3. The Newsletter Electronic Service is provided free of charge for an indefinite period of time. The User can, at any time and without giving any reason, unsubscribe from the Newsletter (Newsletter unsubscribe) by sending an appropriate request to the Service Provider, in particular via the contact form or by e-mail to: ido@rehasport.pl

FINAL PROVISIONS

11.1 If a provision of these Rules and Regulations is found to be invalid or ineffective, this shall , not affect the validity and effectiveness of the remaining provisions of these Rules and Conditions.

11.2. These Rules and Regulations are the property of the Service Provider and is protected by the provisions of the Act on Copyright and Related Rights of 4 February 1994 (Journal of Laws of 2019, item 1231)

11.3. The Service Provider informs that it does not use out-of-court complaint and redress procedures, including the out-of-court resolution of consumer disputes.

11.4. In matters not regulated in these Rules and Regulations, the provisions of commonly applicable law shall apply.

11.5. Services purchased from the Online Shop may not be resold, transferred, lent to a third party without the consent of Rehasport Clinic sp. z o.o.

11.6 Purchased Services, Training and Goods are not exchangeable for other Services, Training or Goods.

11.7 Acquired Services or Training do not replace Services provided on the basis of a legal relationship other than a agreement concluded through the Online Shop.

11.8 The Rules and Regulations are amended by making the amended text of the Rules and Regulations available at sklep.rehasport.pl. The amendment of the Rules and Regulations does not affect the performance of agreements which were concluded before the amendment.
